Illegally dismissed Hoya workers prepare for Certification Election

Tanauan, Batangas –Hoya workers prepared for the Certification Election (CE) of their union tomorrow, July 31. Hoya Glass Disk Phils. (HOGP) closed down on April 30, six days after the Kalipunan at Sanggunian ng Manggagawa sa Hoya Glass Disk Phils. – Independent (KASAMA sa HOGP-IND) was registered on April 24.

The union, through its mobile propaganda team (MPT), made public announcements in front of the Tanauan City hall, calling for support to vote YES in favor of the union. It also put up a symbolic protest camp in front of the First Philippine Industrial Park (FPIP) to pressure the company to resume operations, reinstate all Hoya workers, and recognize the union.

The workers also set up a protest camp in front of the Department of Labor – Region IVA (DoLE- IVA) to serve as vigil site for the CE tomorrow, which will start at 9AM until 3PM.

On April 30, more than 2,600 workers lost their jobs due to the company’s illegal closure. But amidst the DoLE and the company’s underhanded efforts in tricking the workers into signing their waivers and quit claims, members of the KASAMA sa HOGP-IND union pressed for their right to organization.

“The Philippine Constitution and the Labor Code guarantees our right to organization. It is by these laws that we have rightfully insisted, and were supported by different labor organizations in and out of the country, all Hoya workers’ right to being reinstated to the company, having our certification elections, and subsequently recognized as the Sole and Exclusive Bargaining agent. With prices and costs of living endlessly hiking, having a union is the first step to assert for our right to living in decency.” Said Ian Chu Ordonio, President of KASAMA sa HOGP-IND.

However, the management asserted that the 1,874 workers should participate in the election – which the DOLE-IVA favored – even if there are only 78 workers who have not signed the quit claims yet and remained unpaid. This means that only the 78 should be considered as workers and, thus, must be given the right to vote. In the pre-election conference (PEC) last July 15, the management also asserted the non-participation of the union in the Comelec.

“It is clear that Hoya is extremely anti-worker. Until the last efforts of the unionists, the company desperately attempts to manipulate the results to favor them. Despite that, it became clearer to us that the company did not close. We have proven that it only ceased its operations in accordance to ‘cessation of operations’ stated in the document it submitted to the Philippine Economic Zone Authority (PEZA).” Ordonio ended. ###

Manggagawa ng Hoya na iligal na nagsara, naghanda para sa Certification Election

Tanauan, Batangas – Naghanda ang mga manggagawa ng Hoya Glass Disk Philippines (HOGP) para sa ilulunsad na Certification Election (CE) ng kanilang unyon bukas, Hulyo 31. Nagsara ang HOGP noong ika-30 ng Abril, anim na araw matapos mai-rehistro ang Kalipunan at Saligan ng Manggagawa sa Hoya Glass Disk Phils. – Independent (KASAMA sa HOGP-IND) noong Abril 24.

Nag-ikot kaninang umaga ang mobile propaganda team (MPT) ng unyon sa Tanauan City hall upang ipaalam ang magaganap na CE at ipanawagan ang pagboto ng YES pabor sa unyon. Nagtayo din ng simbolikong kubol o protest camp sa harapan ng First Philippine Industrial Park (FPIP) upang igiit sa kumpanya ang pagtutuloy ng operasyon, pagpapabalik sa mga manggagawang iligal na tinanggal, at pagkilala s unyon.

Nagtayo din ang mga manggagawa ng protest camp sa harapan ng Department of Labor and Employment – Region IVA (DoLE-IVA). Magsisilbi itong vigil ng mga manggagawa para sa CE na ilulunsad bukas simula 9AM hanggang 3PM.

Noong ika-30 ng Abril, mahigit 2,600 manggagawa ang nawalan ng trabaho dahil sa iligal na pagsasara ng kumpanya. Ngunit sa kabila ng panlilinlang at panunuhol ng kumpanya, iginiit ng mga manggagawa ang kanilang karapatan sa pag-oorganisa.

“Ginagarantiyahan ng Konstitusyon ng Pilipinas at ng Labor Code ang ating karapatan sa organisasyon. Sa pamamagitan ng mga batas na ito, at ng suporta ng iba’t ibang organisasyon ng manggagawa sa loob at labas ng bansa, makatarungan nating iginiit ang karapatan ng lahat ng manggagawa ng Hoya na maibalik sa kanilang trabaho, na magkaroon ng certification elections, at kilalanin bilang Sole and Exclusive Bargaining agent. Sa patuloy na pagtaas ng presyo ng mga bilihin at halaga ng pamumuhay, ang pagkakaroon ng unyon ay isang hakbang para igiit ang aming karapatan sa disenteng pamumuhay.” Ani Ian Chu Ordonio, tagapangulo ng KASAMA sa HOGP-IND.

Samantala, iginiit ng management na pabotohin ang 1,874 manggagawa – na siya naming pinaboran ng DOLE-IVA – gayong 78 na lang ang hindi pa pumipirma ng quit claims at hindi pa nababayaran. Ibig sabihin, 78 na lang dapat ang ikokonsiderang empleyado pa ng kumpanya at may karapatang bomoto. Sa pre-election conference (PEC) na inilunsad noong Hulyo 15, iginiit din ng management na ‘wag palahukin ang unyon sa Comelec.

“Malinaw ang sagad-sagaring pagiging kontra-manggagawa ng kapitalistang Hoya. Hanggang sa huling pagsisikap ng mga unyonista ng KASAMA sa HOGP-IND ay pinipilit ng kumpanya na manipulahin ang resulta para pumabor sa kanila. Gayunman, mas naging malinaw din sa aming mga manggagawa na hindi nagsara ang kumpanya. Napatunayan namin na tumigil lang ito ng operasyon batay na rin sa ‘cessation of operations’ na nakasaad sa dokumentong ipinasa nito sa Philippine Economic Zone Authority (PEZA).” Pagtatapos ni Ordonio. ###
